EXCLUSION OF PRESS AND PUBLIC

Decision: It was RESOLVED that under Section 100(A)(4) of the Local Government Act 1972, the press and public be excluded from the meeting for the following items of business on the grounds that they involve the likely disclosure of exempt information as defined in Paragraph 4 of Part 1 of Schedule 12A of the Act.

APPEAL AGAINST THE SERVING OF A COMPULSORY PURCHASE ORDER - PROPERTY IN YORK ROAD

Status: Agreed

Business: The Chair introduced those present to the appellant and explained the procedure to be followed at the meeting, a copy of which had been sent to him in advance.

The appellant presented his case verbally and in writing to the Committee The Environmental Health Officers and Members of the Committee asked questions of the appellant.

The Committee considered the report of the case and verbal presentation by the Environmental Health Officers. The appellant and Members of the Committee asked questions of the Environmental Health Officers.

The Environmental Health Officers and appellant made closing speeches, following which they withdrew from the meeting whilst the Committee considered the matters raised.

During the Committee's deliberations, the Principal Solicitor drew Members' attention to a letter from the Official Solicitor to the Supreme Court explaining why his Office was unable to act on the appellant's behalf, and to a letter from the Stevenage Community Mental Health Service in respect of the appellant.

Decision: Following consideration of the case, it was RESOLVED:

1. That the appeal made by Mr. J.M. against the Head of Environmental Health Services' decision to make a Compulsory Purchase Order on 306 York Road be dismissed for the following reasons:-

(a) The Committee was satisfied with the evidence given by Officers, and acknowledged that, despite various attempts to bring the property back into occupation, the appellant had resisted such attempts. In view of the fact that the property had been unoccupied for over 6 years, the Committee considered that a Compulsory Purchase Order was warranted.

(b) The Committee considered that, from the evidence given, the appellant had been unable to demonstrate that, for the foreseeable future, he would have access to the resources necessary to bring the property up to a habitable condition ready for occupation.

2. That the Compulsory Purchase Order be submitted to the Secretary of State (Office of the Deputy Prime Minister) for confirmation.

Business: The Committee noted that, with the agreement of both parties, this matter had been adjourned prior to the meeting. The Principal Solicitor advised Members of the reason for the adjournment.

APPLICATION FOR PRIVATE HIRE DRIVER'S LICENCE - MR R.N.Y

Status: Agreed

Business: The Chair introduced those present to the applicant and explained the procedure to be followed at the meeting, a copy of which had been sent to him in advance.

The applicant presented his case verbally to the Committee. The Hackney Carriage Licensing Officer and Members of the Committee asked questions of the applicant.

The Committee considered the report of the case and verbal presentation by the Hackney Carriage Licensing Officer. The applicant and Members of the Committtee asked questions of the Hackney Carriage Licensing Officer.

The Hackney Carriage Licensing Officer and applicant made closing speeches, following which they withdrew from the meeting whilst the Committee considered the matters raised.

Following consideration of the case, the applicant and Hackney Carriage Licensing Officer were invited back into the meeting to hear the Committee's decision.

Decision: It was RESOLVED that the applicant be granted a Private Hire Vehicle Driver's Licence, with effect from 23rd October 2003, for the remainder of the 2003/04 Licensing Year.
