Decision: It was RESOLVED that the Minutes of the meeting of the Committee held on 18th May 2006, having been circulated, be taken as read, confirmed and signed by the Chair as a correct record.

URGENT PART I BUSINESS

EXCLUSION OF PRESS AND PUBLIC

Status: Noted

Decision: It was RESOLVED that under Section 100(A) (4) of the Local Government Act 1972, the press and public be excluded from the meeting for Items 5, 6 and 7 below on the grounds that they involve the likely disclosure of exempt information as defined in Paragraphs 4 and 14 of Part I of Schedule 12A of the Act.

MR SN HACKNEY CARRIAGE DRIVERS LICENCE

Status: Not Agreed

Business: The Committee were advised that Mr. S.N. would not be attending the hearing.

Members agreed that the review of Mr. S.N.'s Hackney Carriage Drivers Licence would go ahead in Mr. S.N.'s absence, having satisfied themselves that he had received the officers report and had been given every opportunity to express views as to whether the matter should proceed.

The Committee considered the facts of the case, as presented by the Licensing Officer. The Members of the Committee asked questions of the Licensing Officer.

The Licensing Officer withdrew from the meeting whilst the Committee considered the matters raised.

Following consideration of the case by Members, the Licensing Officer was invited back into the meeting to hear the Committee's decision.

Decision: It was RESOLVED:-

That the Committee, having considered the matter carefully, and taking account of all the relevant factors decided to revoke Mr. S.N.'s Hackney Carriage Drivers Licence in that the Committee had taken into consideration all the evidence put forward to it, both orally and in writing, and in particular, the convictions of Mr. S.N. dated 9th January 2001 and 23rd November 2004 and his failure to disclose them in his application form. As a result the Committee came to the conclusion that there were reasonable grounds for revocation of Mr. S.N.'s licence.

Mr. S.N. would be notified of the decision of the Committee and advised of his right to appeal.

MR DN HACKNEY CARRIAGE DRIVERS LICENCE

Status: Not Agreed

Business: The Committee Administrator introduced the applicant to the Committee.

The Chair introduced the Members and officers present to the applicant and explained the procedure to be followed at the meeting.

The Committee considered the facts of the case, as presented by the Licensing Officer. The applicant and Members of the Committee asked questions of the Licensing Officer.

The applicant presented his case verbally to the Committee. The Licensing Officer and Members of the Committee asked a number of questions of the applicant.

The Licensing Officer and the applicant both made closing speeches, following which they withdrew from the meeting whilst the Committee considered the matters raised.

Following a thorough consideration of the case by Members, the applicant and the Licensing Officer were invited back into the meeting to hear the Committee's decision.

Decision: It was RESOLVED:-

That the Committee having considered the matter carefully and taking account of all relevant factors decided to suspend Mr. D.N.'s Hackney Carriage Driver's Licence until 23rd November, 2007 in that the Committee had taken into consideration all the evidence put forward to it, both orally and in writing, in particular the Committee considered the convictions of Mr. D.N. dated 23rd November 2004 and his failure to disclose them in his application form. As a result the Committee came to the conclusion that there were reasonable grounds for suspension of Mr. D.N.'s Licence.

Mr. D.N. was advised of his right to appeal.

MR D HACKNEY CARRIAGE DRIVERS LICENCE

Status: Not Agreed

That the Committee having considered the matter carefully and taking account of all the relevant factors decided to suspend Mr. D.'s Hackney Carriage Driver's Licence until 15th December 2006, in that the Committee had taken into consideration all the evidence put forward to it, both orally and in writing, in particular the Committee considered the convictions of Mr. D. and his failure to disclose them in his application form, the incident reported to the Police in February 2002 and the said incident's explanation by the applicant. The Committee came to the conclusion that there were reasonable grounds for suspension of Mr. D.'s Licence for six months from today - 16th June 2006 as stated above.

Mr. D. was informed of his right of appeal.
